DON JUAN & CO LTD - Skill-based Prize Competition

1. Organizer

This competition is organised by:

DONJUAN&CO LTD, a company incorporated and registered in England and Wales, with its registered office at:

United Kingdom

(hereinafter referred to as the “Organiser”).

2. Legal classification

This promotion constitutes a skill-based prize competition under the Gambling Act 2005.

It is not a lottery as:
• entry requires the correct answer to a skill-based question;
• the question is designed to prevent a significant proportion of participants from answering correctly;
• only valid entries (correct answer + valid payment) are entered into the draw.

No gambling services are provided. The Organiser does not require a licence from the UK Gambling Commission.

3. Eligibility

Participation is strictly limited to individuals who:
• are aged 18 years or over at the time of entry;
• have full legal capacity to contract;
• reside in jurisdictions where such competitions are lawful;
• are not prohibited by applicable law;
• are not employees, contractors, agents, partners, or immediate family members of the Organiser.

The Organiser reserves the right to request, at any time:
• valid government-issued identification;
• proof of address;
• passport copy;
• age verification documentation.

Failure to provide such documentation within 14 days may result in disqualification at the Organiser’s sole discretion.

4. Entry mechanism

4.1 Ticket Purchase

• Price per entry: £30
• Maximum: 10 entries per person per competition
• Each ticket constitutes one independent entry

Entries are only valid upon:
• successful payment clearance;
• correct answer to the skill question.

The Organiser reserves the absolute right to:
• reject or void any suspicious transaction;
•cancel entries suspected of fraud, abuse, or irregularity.

4.2 Skill-based Question

Participants must correctly answer a skill-based question prior to completing their entry.

• Incorrect answers automatically invalidate the entry;
• The Organiser may vary the question per competition;
• No alternative entry route is provided.

This requirement ensures compliance with UK law.

5. Winner Selection

The winner will be selected from all valid entries via an independent random draw system, including but not limited to:
RandomDraws (TPAL certified system)

The Organiser:
• may record or publish the draw;
• reserves the right to audit, delay, or re-run the draw in case of irregularity.

The Organiser’s decision is final and binding.

6. Prize

The prize consists of an all-inclusive yacht experience, including:
• yacht charter;
• crew services;
• predefined itinerary;
• meals and beverages on board;
• return flights (excluding departures from the Americas and Asia).

The prize:
• is non-transferable, non-refundable, and non-exchangeable;
• has no cash alternative;
• must be used on fixed dates;
• is subject to third-party provider terms and availability.

The Organiser reserves the right to substitute the prize with one of equal or greater value if necessary.

7. Winner Obligations

The winner must:
• comply with all eligibility criteria;
• provide requested documentation within 14 days;
• be available on the specified travel dates;
• hold a passport valid for at least 6 months.

Failure to comply may result in:
• forfeiture of the prize;
• selection of an alternative winner.

8. minimum tickets threshold

Each competition has a maximum number of entries.

If the minimum operational threshold is not met, the Organiser may:
• cancel the competition;
• issue full refunds to all participants;
• decline to award any prize.

Refunds will be processed via the original payment method only.

9. Limitation of liability

To the fullest extent permitted by law, the Organiser shall not be liable for:
• technical failures, system errors, or platform outages;
• network, server, or software malfunctions;
• delays, cancellations, or failures by third-party providers;
• events beyond reasonable control (force majeure).

The Organiser’s total liability shall be strictly limited to the amount paid by the participant.

Under no circumstances shall the Organiser be liable for:
• indirect, consequential, or incidental losses;
• loss of profit, opportunity, or enjoyment.

Nothing in these terms excludes liability for death or personal injury caused by negligence or fraud.

10. fraud, AML & compliance

10.1 KYC/AML Checks

The Organiser reserves the right to:
• conduct identity verification checks;
• perform anti-money laundering screening;
• request additional documentation;
• suspend or refuse participation.

The prize may be withheld pending verification.

10.2 Prohibited conduct

Strictly prohibited:
• use of bots, scripts, or automation;
• multiple or duplicate accounts;
• false identities or misrepresentation;
• abusive chargebacks or payment disputes;
• manipulation of the system.

The Organiser reserves the right to:
• cancel entries;
• terminate accounts;
• refuse future participation;
• pursue legal action.

11. Data protection

All personal data is processed in accordance with:
• UK GDPR
• Data Protection Act 2018

Data is used solely for:
• administration of the competition;
• identity verification;
• prize fulfilment.

Data may be shared with:
• draw system providers;
• identity verification services;
• payment processors;
• anti-fraud agencies.

Participants have the right to access, rectify, and erase their data.

12. Publicity

By entering, the winner agrees to:
• reasonable publicity related to the prize;
• use of their first name and city;
• possible photo/video content.

Refusal may result in disqualification unless prohibited by law.

13. Force majeure

The Organiser shall not be liable for failure or delay due to events beyond reasonable control, including but not limited to:
• natural disasters;
• pandemics;
• government restrictions;
• transport disruptions;
• war, strikes, or civil unrest.

In such cases, the Organiser may:
postpone, modify, or cancel the competition or prize.

14. Governing laws

These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.

All disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Amendments

The Organiser reserves the right to amend these Terms at any time for legal, regulatory, or operational reasons.

The applicable version is the one in force at the time of entry.
